Distance Selling

Since the Rosengren rulingby the European Court of Justice in 2007, it has become possible for Swedish private individuals to import alcohol from other EU countries through distance selling. The ruling established that private individuals have the right to purchase alcohol from foreign sellers, as long as the goods are transported by an independent party.

Vino Nordica complies with all Swedish regulations for distance selling, and holds a permit from the Swedish Tax Agency for ongoing payment of Swedish VAT and alcohol tax.


The Rosengren Ruling

The ruling was based on Article 34 of the Treaty on the Functioning of the European Union (formerly Article 28 of the EC Treaty), which prohibits quantitative import restrictions and measures having equivalent effect between member states.

Sweden had a ban on private alcohol imports (in order to protect Systembolaget’s monopoly), which the court deemed a hindrance to the free movement of goods within the EU. Although Sweden cited public health reasons, the court found the ban to be disproportionate and stated that the objectives could be achieved through less restrictive means, such as taxation or age controls.


In Summary

The ruling established that Swedish consumers have the right to purchase alcohol from other EU countries, provided the buyer is a private individual and the transport is carried out by an independent party. This set a precedent for distance selling of alcohol within the EU.
